Thank you for visiting our website and for your interest in our company and our products. We take the protection of your private data seriously and want you to feel comfortable visiting our website.

When you use this website, personal data will be processed by us, being the data controller, responsible for data processing, and stored for the duration necessary to fulfil the defined purposes and legal obligations. In the following we will inform you about the kind of data that is involved, how it is processed and the rights you are entitled to.

In accordance with Art. 4 No. 1 of the Basic Data Protection Ordinance (DSGVO), personal data is any and all information relating to an identified or identifiable natural person (hereinafter “data subject or user”).

2. Collection and storage of personal data as well as type, purpose and use

a) When visiting our website

When you visit our website www.minusl.de, the browser on your device automatically sends information to the server on our website. This information is temporarily stored in a so-called log file. Without your intervention, the following information is recorded and stored within 7 days until automated deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which access is made (referrer URL),
  • Browser type and version as well as
  • other information transmitted by the browser (such as your computer’s operating system, the name of your access provider, geographical origin, language setting, etc.).

The mentioned data will be processed by us for the following purposes:

  • to ensure a smooth connection of the website,
  • to ensure comfortable use of our website,
  • to evaluate the system security and stability as well as
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f DSGVO. Our legitimate interest is in line with the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

b) When using our contact form

For questions of any kind, to order information material or to express product wishes, questions, suggestions, improvement suggestions or to send positive feedback, we offer you the opportunity to contact us via a form provided on our website. In addition to your request, we require a valid e-mail address, form of address and surname so that we know who sent the request and can respond to it in a personalized manner. Institution, title and first name can be given voluntarily.

Data for the purpose of contacting us will be processed in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO on the basis of your voluntary consent.

Personal data collected by us for the purpose of the contact form will be deleted after your request has been processed. In the event that you provide health-related information, we will store your message without a name and/or sender address. In case of further inquiries in connection with this at a later time, we will be able to reproduce the communication with you.

 

c) When subscribing to our newsletter

If you have expressly consented within the meaning of Art. 6 para. 1 sentence 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an e-mail address. Your name and your interests are optional and serve to adapt the newsletter to your individual needs.

You can unsubscribe at any time, e.g. via a link at the end of each newsletter. Alternatively, you can also send your request to unsubscribe via e-mail to info@minusL.de.

We send our newsletter via the provider CleverReach of CleverReach GmbH & Co. KG, Mühlenstr. 43, 2618 Rastede, Germany (“CleverReach”). CleverReach processes your personal data on our behalf in order to send and evaluate the newsletter to you. CleverReach is a member of the Certified Senders Alliance, which has established its own guidelines for permitted email marketing.

We can measure and evaluate the behavior of our newsletter recipients using CleverReach. These include the opening, click, bounce, delivery, unsubscribe, conversion and social sharing rates. We also use the tool Google Analytics in the newsletter to analyze how the newsletter relates to the purchase of a product. This is done by attaching the corresponding parameters to all links in the newsletter. If you click on the link, we place a small text file (cookie) on your computer. This enables us to precisely assign the newsletter as the starting point for visiting the website. If you visit our website within 14 days, this information will be displayed to us.

CleverReach can implement social media buttons from Twitter, Facebook, LinkedIn and Xing in the newsletter on our behalf. By clicking on the corresponding button, a direct connection to the servers of the button provider is established.

d) When making contact via social media

We also offer you extensive personal support via social media channels, such as Facebook. Social media themselves collect personal data, for example about the data stored in their profile or collected during use or via so-called social plug-ins that are implemented in third-party websites. OMIRA has no influence on the collection and processing of your personal data by social media. Further information can be found in the data protection information of the respective social media.

If you contact us via social media, we will forward the request to the responsible department in the OMIRA group of companies, which will then contact you via the social network. In the event that you provide us with your email address, we will contact you.

This data will only be used to answer your inquiry.

 

e) By registering in our press and expert area

As a press representative you have the possibility to receive registration data for our closed press area and therefore get access to press releases and other useful information. Doctors and nutritionists can also obtain registration data for our expert area to access useful specialist articles and the order form for our information material.

To register in these areas, please use the contact form. You will then receive a user name and password for the corresponding closed area from us. The data you provide will be used exclusively for registration and further communication in accordance with your requests in the closed area, they will not be used in any other way or for advertising purposes.

3. Disclosure of personal data to third parties

We do not pass on your personal data to third parties, except to our e-mail service CleverReach. Different rules only apply if:

  • you have given your expressed consent pursuant to Art. 6 para. 1 sentence 1 lit. a DSGVO;
  • this is necessary for the fulfilment of a contract with you pursuant to Art. 6 para. 1 sentence 1 lit. b DSGVO;
  • in the event that a legal obligation exists for the transfer pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO.

The data passed on may be used by the third party only for the named purposes.

4. Cookies

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do no damage to your end device, and do not contain viruses, Trojans or other malware.

Information is stored in the cookie that results in a connection with the specifically used terminal device in each case. However, this does not mean that we immediately become aware of your identity.

The use of cookies serves to make the use of our offer more pleasant for you. 5. Analysis- and tracking tools

The analysis and tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 f DSGVO.

By using analysis and tracking measures, we want to ensure that our website is designed to meet requirements and is continually optimized. Additionally, we use analysis and tracking measures in order to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you.

These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

 

a) Google Analytics

We use Google Analytics, a web analysis service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: “Google”). In this context, pseudonymized user profiles are created and cookies are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • Operating system used,
  • Referrer URL (the previously visited page),
  • Host name of the accessing computer (IP address),
  • Time of the server request,

are transferred to a Google server in the USA and stored there. Google complies with the data protection regulations of the EU/US Privacy Shield and is registered with the US Privacy Shield Program of the US Department of Commerce. In addition, we have concluded an order processing agreement with Google for the use of Google Analytics. Through this contract, Google assures that it will process the data in accordance with the basic data protection regulation and guarantees the protection of the rights of the data subject.

The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and the internet for the purposes of market research and demand-oriented design of these internet pages.

This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google. The IP addresses are anonymized so that an assignment is not possible (IP masking).

You may refuse the use of cookies by selecting the appropriate settings on your browser. However, we would like to point out that in this case not all features on this website may be used in full.

b) Google AdWords Conversion Tracking

We use Google Conversion Tracking by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: “Google”) on our website in order to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer. Google Adwords sets a cookie on your computer if you have accessed our website via a Google ad.

These cookies expire after 30 days. If the user visits certain pages of the AdWords customer’s website and the cookie has not yet expired, Google and the customer can identify that the user has clicked on the ad and has been redirected to this page.

The information generated by the cookie about your use of this website is transferred to a Google server in the USA and stored there. Google complies with the data protection regulations of the “US Privacy Shield” and is registered with the “US Privacy Shield” program of the US Department of Commerce. In addition, we have concluded an order processing agreement with Google for the use of Google AdWords. Through this contract, Google assures that it will process the data in accordance with the basic data protection regulation and guarantees the protection of the rights of the data subject.

Each AdWords customer receives a different cookie. Cookies can therefore not be traced through the websites of AdWords customers. The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. We see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they will not receive any information that personally identifies users.

If you do not wish to participate in the tracking process, you can also reject the setting of a cookie required for this – for example using a browser setting that generally deactivates the automatic setting of cookies. You can also deactivate cookies for conversion tracking by setting your browser to block cookies from the “www.googleadservices.com” domain.

c) Google Tag Manager

We also use the Google Tag Manager tool from Google on our website. Google Tag Manager is the tool we use to manage the tools described in this privacy statement. For details on these tools, refer to the information on the specific tool.

The Tool Tag Manager itself (which implements the tags) is a cookieless domain. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If deactivation has been made at the domain or cookie level, it will remain in effect for all tracking tags implemented with Google Tag Manager.

d) Google Remarketing

We use Google Remarketing. These are services by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). Google uses cookies which are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google is subject to the EU-US Privacy Shield, so that an appropriate level of data protection is guaranteed.

The IP address will then be shortened by the last three digits by Google, a clear assignment of the IP address is no longer possible. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage.

Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. Third parties, including Google, create ads on websites on the internet. Third-party providers, including Google, use stored cookies to create ads based on a user’s previous visit to this site. Google will not associate your IP address with any other data held by Google. The collection and storage of data can be revoked at any time with effect for the future. 6. Youtube

We use components (videos) of the company YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA (hereinafter: “YouTube”), a company of Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter: “Google”), on our Internet pages on the basis of consent pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO.

In doing so we use the option of the “extended data protection mode” provided by YouTube.

When you access a page that has an embedded video, it connects to the YouTube servers and displays the content on the website by notifying your browser.

According to YouTube, your data – in particular which one of our Internet pages you have visited and device-specific information including the IP address – will only be transmitted to the YouTube server in the USA when you watch the Video while in the “extended data protection mode”. By clicking on the video, you consent to this transmission.

If you are logged in to YouTube at the same time, this information will be associated with your YouTube account. You can prevent this by logging out of your member account before visiting our website.

Google complies with the data protection regulations of the “US Privacy Shield” and is registered with the “US Privacy Shield” program of the US Department of Commerce.

7. MinusL Fanpage

To improve the success of our Facebook fan page, we use Facebook Insights. To do this, Facebook places cookies on the computer or any other device of the people who have visited our fan page, which serve to store information in the web browsers. The information stored in the cookies is received, recorded and processed by Facebook, especially when a person visits the Facebook services, services provided by other members of the Facebook group of companies and services provided by other companies using the Facebook services. In addition, other sites such as Facebook partners or even third parties on the Facebook services may use cookies to provide services to companies advertising on Facebook. One of the purposes of such processing of personal data is to enable Facebook to improve its advertising system, which it distributes via its network. 8. Rights of persons concerned

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
  • to immediately request the correction of incorrect or complete personal data stored by us in accordance with Art. 16 DSGVO;
  • to request the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • to restrict the processing of your personal data pursuant to Art. 18 DSGVO, if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing pursuant to Art. 21 DSGVO;
  • to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request its transfer to another person pursuant to Art. 20 DSGVO;
  • to revoke your consent to us at any time in accordance with Art. 7 para. 3 DSGVO,. As a result, we are no longer allowed to continue processing data based on this consent in the future and
  • to complain to a supervisory authority pursuant to Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company Headquarters.

9. Right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 letter f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that there are reasons for this which arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which we will implement without specifying a particular situation.

10. Data security

All data transmitted by you personally is encrypted using the generally accepted and secure standard TLS (Transport Layer Security). TLS is a secure and proven standard that is also used in online banking, for example. You can recognize a secure TLS connection by the ending “s” on http (i.e. https://..) in the address bar of your browser or by the lock symbol at the bottom of your browser.

We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.

11. Up-to-dateness of the data protection policy

This data protection policy is currently valid and is the version as of May 2018.
